High Court suspends KSh1.5 million IEBC fine on Kipipiri MP

Kipipiri Member of Parliament (MP) Wanjiku Muhia breathed a sigh of relief after Milimani High Court temporarily halted the decision by the Independent Electoral and Boundaries Commission (IEBC) to fine her KSh1.5 million.

Muhia was slapped with the fine, as IEBC said the lawmaker breached the Electoral Code of Conduct by making controversial comments. Now, the fine has been halted temporarily after Justice Nabil Mokaya Orina on Monday, July 13, 2026, issued the interim orders.

Sigh of relief

The MP will now not pay the fine until the determination of a petition filed by Wanjiku challenging the IEBC’s move is heard and determined.

“In the meantime, pending the hearing and determination of the application, an order be and is hereby issued staying the judgment of the 2nd respondent issued on July 10, 2026,” Mokaya ordered.

The MP argued that the IEBC committee required her to pay the fine on Monday, July 13, 2026, at 4 am, and according to her, the time allocation was very short.

The DCP-allied MP states that the committee issued its judgement on Friday, July 10, 2026, but was served to her advocates on Saturday, July 11, 2026, at 18:19 hours, 24 hours later, thus leaving her with eight hours to raise the amount.

She argues that the amount she was ordered to pay is unreasonable and irrational. The MP accuses the committee of refusing and failing to provide her with the proceedings or transcripts of its proceedings despite her advocates requesting them four times and on various dates.

The matter is set to be mentioned on July 20, 2026.
