Mukurwe-ini Member of Parliament (MP) John Kaguchia, on a Ksh100,000 cash bail, has been released following a court order.
The Kiambu High Court ordered the release of the MP, who was arrested on Monday, August 3, 2026.
The arrested MP filed an application against the Inspector General of Police (IG) and the Director of Public Prosecutions (DPP) and one other after he was arrested and got a reprieve as the court ordered that he be set free.
Justice Njoki Mwangi ordered the release of the legislator, who was arrested after making controversial remarks, on a police cash bail pending the hearing and determination of his application.
“The applicant (MP Kaguchia) shall be released forthwith from police custody upon deposit of police cash bail in the sum of Ksh100,000,” Justice Mwangi ordered.
Gachagua welcomes Kaguchia’s release
“The High Court of Kenya has ordered the immediate release of Hon. John Kaguchia from police custody upon payment of a police cash bail of Ksh100,000,” Gachagua said.
“The OCS of Kamukunji Police Station is being misled by his seniors into ignoring the court order, which has already been served upon him, and continuing to detain Hon John Kaguchia.”
“My advice to the OCS is to obey the court order, as he will be held personally liable for contempt of court. When that time comes, his seniors will be nowhere to be found when he is cited for contempt.
“He must remember that his colleague, the OCS of Central Police Station, is still in remand prison, charged with murder after obeying unlawful orders to torture the late Albert Ojwang at Central Police Station.”
Babu Owino reacts to Kaguchia’s arrest
“Following the arrest of the first-term MP, Embakasi East Member of Parliament Babu Owino condemned the move by police to seize his counterpart,” Babu said.
“We strongly condemn the arbitrary arrest of Hon. John Kaguchia by the government over his remarks. Some people may disagree with what he said, but in a constitutional democracy, disagreement is never a justification for arrest.”
Freed of speech
Babu said freedom of expression exists to protect not only popular speech but also speech that is unpopular, controversial, or critical.
“We will defend, to the fullest extent of the law, every person’s right to speak freely without fear of intimidation, harassment, or arbitrary arrest. The proper response to speech is more speech, not unlawful repression. A nation that punishes words instead of crimes places the liberty of all its citizens at risk,” Babu stated.
