A football stakeholder – Jared Ondieki’s questions over the legitimacy of the forthcoming elections comes up for hearing at the Sports Disputes Tribunal Tuesday afternoon, the petitioner arguing the whole electoral process is flawed and illegal.
Ondieki accuses the federation of bias and lacking transparency in the forthcoming elections, calling on the SDT to declare the composition of the electoral board, which includes the tribunal vice chairperson – Elynah Shivekah, as a member.
He contends that Shiveka is a person of interest should any disputes arise from the scheduled polls because her presence on the EB would most likely compromise the delivery of justice.
Through his lawyers, the petitioner – a member of Nyamira sub-branch, had earlier asked the SDT to find the 7 December polls a nullity because it did not meet the threshold of credibility and neither did the process conform to the provisions of Article 81 of the Constitution that define the principles of democracy.
Today was arrived at as the new hearing date after both parties requested for time to file written submissions.
FKF President Nick Mwendwa and Elections Board Chairman – Professor Edwin Wamukoya, who are being accused of been party to an illegal exercise that does not meet the basic tenets of democracy.
The matter will be heard by a bench of three members, led by SDT chairman John B Ohaga; with Njeri Onyango and Mary Kimani as members.
According to FKF, the elections are to take place on 23 November.
