The Deputy Chief Justice has will endure a two-month wait to know whether or not she will be prosecuted over corruption and abuse of office allegations.
Philomena Mwilu petitioned a move by the Director of Public Prosecutions to institute corruption, fraud and bribery as well as tax evasion charges.
A five-judge bench hearing the case set the May 31 date after the parties concluded their submissions in court.
DPP Noordin Haji’s prosecution team is led by Queen’s Counsel, Khawar Qureshi, while the team of lawyers acting for Mwilu is led by Siaya Senator – James Orengo, a senior counsel.
The prosecution wants the court to dismiss the DCJ’s petition challenging her prosecution, QC Qureshi arguing they have evidence to sustain criminal proceedings against her.
Mwilu submits that the charges have no legal basis, accusing the DPP of malice, ill-will and being politically motivated.
