The High Court has granted former Cabinet Secretary Raphael Tuju anticipatory bail of KSh200,000 following his dramatic arrest, offering temporary relief amid mounting legal and political scrutiny.

Justice Martin Muya issued the orders on 24 March 2026 after Tuju’s legal team filed an urgent application seeking to block his arrest and continued detention.

Lawyer Gregg Ndege argued that the arrest was unlawful and violated Tuju’s fundamental rights.

The court ordered that Tuju be admitted on an anticipatory bond of KSh200,000 with one surety or a cash bail of a similar amount. The case will be mentioned for further directions on 7 April 2026.

Arrest sparks conflicting accounts

Tuju was arrested on Monday afternoon at his Karen residence in Nairobi, hours after resurfacing following claims that he had gone missing.

Before his arrest, Tuju said he had gone into hiding for fear of his life after noticing he was being trailed by an unmarked vehicle.

However, the Directorate of Criminal Investigations dismissed the claims. DCI Director Mohamed Amin said investigations showed Tuju remained at his residence throughout the period in question.

Amin said forensic analysis indicated Tuju was at home even at the time his phone was switched off at 6.18pm (EAT) on 21 March 2026.

Following his arrest, Tuju was rushed to Karen Hospital after his health reportedly deteriorated.

His legal team said he was mishandled during the arrest, contributing to his condition.

Tuju failed to appear in court for plea taking, with his lawyers, led by Kalonzo Musyoka, telling the court he remained admitted in hospital.

The case has intensified scrutiny over police conduct and the use of anticipatory bail, with questions raised about the circumstances surrounding his arrest.
